Raped By Guard

An attractive young woman visiting her fiance, a life prisoner at the state prison at Somerset in Southcentral Pennsylvania was sexually assaulted by a guard employed in the prison visiting room. During a visit, the guard (who's name we are withholding in deference to his family) called the prisoner to the visiting room desk. He slid a note to the prisoner which said in effect that the guard would permit the man to sneak into the restroom with his fiancee to have sex if the guard could have sex with her, too.

The couple was terrified about what would happen to their visiting privileges and to the prisoner if they refused the proposition. Adding to their stress, both were sexually starved from three years of forced abstinence (foolishly, Pennsylvania doesn't have conjugal visiting). Since the man was doing life, they might never be able to be intimate again.

The prisoner decided that they could take advantage of the opportunity and then the woman could simply refuse to permit the guard to assault her.

The guard didn't risk accosting the visitor in the prison, but confronted her at the motel where she was staying. The young woman was so concerned about what the guard and his cronies would do to her fiance if she refused to accede to the guard's pressure, that she reluctantly performed the oral sex that he was demanding. She'd already seen how viciously brutal the prison guards are because they'd beaten her fiance when he was first imprisoned.

Ashamed and disgusted by the abuse, the woman resolved not to allow the guard to force her into more sex. When he showed up at her motel after a subsequent visit, she flatly refused his threats and told him "never again! Leave!"

The woman's refusal resulted in a pattern of cruel retaliation. The couple's visits were harassed and terminated. The prisoner was thrown into the hole and repeatedly written up. At length, when matters were no longer endurable, the prisoner went to the security captain and explained what had happened. Of course, that was a mistake. NEVER trust the prison staff to act lawfully.

The prisoner was transferred to the prison at Mahanoy near Pottsville, PA, and thrown into the hole. The guard was discharged, but not criminal prosecuted. The Department of Corrections ("DOC") condones and even facilitates sexual and other misconduct by prison staffs.

At the Mahanoy prison, the prisoner continued to suffer retaliation, write ups, time in the hole and intimidation. A panel of prison officials at Mahanoy called the Program Review Committed, threatened the prisoner with more time in the prison hole if he didn't "cooperate" with efforts to get the rapist guard reinstated to his job.

The woman wants to go to the police to have the guard prosecuted which is what she should have done in the first place. The couple wants to bring a legal action against the guard and the DOC for the sexual assault, cover up and retaliation. They are hesitant because of the retaliation on the prisoner and the interference the prison is imposing on their visiting, mail and phone calls.
