Some of the federal courts in Pennsylvania use magistrates to hear suits brought by prisoners. First class citizens can get first class federal judges (if birds like Sylvia Rambo, Malcolm Muir and Donald J. Lee can be called first class), but prisoners are stuck with drunks, twerps, failed lawyers, and political hacks who get paid to be federal magistrates. What a collection of legal mice! In Yiddish we call it "dreck!".
In the middle of Pennsylvania's three federal court districts there's a Magistrate named Raymond Durkin. In Yiddish we call it "dreck!" We'd like to share our opinions about Magistrate Durkin known by jailhouse lawyers as "Neigh."
We don't think that this blathering legal incompetent gets paid directly by the DOC (Department Of Corrections), but we could be wrong. We do know that many suits by suffering prisoners are tossed to him like bones to a slavering cur. His job is to make sure that the prisoners continue to suffer, so he gnaws away on prisoners' already fragile rights. Law is not allowed to interfere with bias.
With a number of others, we recently got involved in a suit, Vorhauer verses Horn, in Middle District Federal Court. The suit was brought by imprisoned and un-imprisoned persons against the alarmingly oppressive, intrusive and unconstitutional mail regulations adopted by the extremists of the Ridge Reich.
True to form, Judge McClure (a man generally regarded as "fair" whatever that means in terms of prisoners) gave the bone to Neigh Durkin. He promptly chewed up the prisoners (along with us "free" persons) and puked the case out of court without even the irritation of a hearing. We un-imprisoned persons were reduced to the rights of the prisoners and then legally abused.
It seems to us that the idea of a court, even a court in Pennsylvania (hub of Ridge corruption), even a court for prisoners and their loved ones, should be impartial, fair, just, "blind." That's not the case with Neigh. He doesn't make even the pretext of fairness or legal abstraction. He knows his job. It's to grind up the prisoners. He does it with zealous gusto of a rabid tyrant who enjoys witnessing oppressed victims.
There must be some way to get rid of a federal magistrate, maybe impeachment, recall or commitment to Bedlam. Not being steeped in the arcane drivel of federal legal double speak, we aren't sure what to do about Neigh. It you have any ideas, let us know. Maybe the Pennsylvania Bar Association has some ideas. We'll have to email this to them. In the mean time, drop the "fair" Judge McClure a line. Ask him to just give prisoner suits directly to the Department of Corrections. Why bother with the pretext of a trained Pekingese?
